A RESOLUTION


Authorizing the conveyance of certain state owned real property located in City of Thomaston, Upson County, Georgia; to repeal conflicting laws; and for other purposes.

WHEREAS:
(1) The Georgia Department of Transportation, an agency of the State of Georgia, is the owner of a certain parcel of real property located in the City of Thomaston, Upson County, Georgia;
(2) Said real property is all that tract or parcel of land containing 4.03 acres, more or less, together with all improvements thereon, in the Southwest part of the City of Thomaston, Upson County, Georgia, bounded as follows: North by lands formerly owned by R. E. Hightower, Sr.; East by lands formerly owned by M. C. & P. N. Johnston; and South and West by lands formerly owned by the Citizens & Southern Bank of Thomaston, Georgia. This is the same tract conveyed to said City of Thomaston by deed of J. W. McDaniel recorded in Deed Book 41, page 32 in the Clerk´s Office, Upson Superior Court; but a plat showing an accurate survey of said tract as here conveyed is recorded in Plat Record One at page 33 in said Clerk´s Office, and is by reference herein made a part of the description of said tract;
Tract "A"
Commencing at a concrete marker found monumenting the Northwest corner of tract owned by the Department of Transportation; Said point being the point of beginning; thence a Bearing of N 53°02ʹ12" E and Distance of 274.74'; thence a Bearing of S 38°22ʹ28" E and Distance of 47.15'; thence a Bearing of S 39°24ʹ07" E and Distance of 100.07'; thence a Bearing of S 39°35ʹ08" E and Distance of 99.96'; thence a Bearing of S 40°31ʹ52" E and Distance of 70.17'; thence a Bearing of S 38°46ʹ13" E and Distance of 244.40'; thence a Bearing of S 14°48ʹ37" W and Distance of 4.87'; to a curve of radius 272.84' and a central angle of 7°50ʹ37"; thence along the arc of the said curve of curve length 37.35'; said curve having a chord bearing and length of N 42°21ʹ57" W and 37.32'; thence a Bearing of N 38°26ʹ38" W and Distance of 39.14'; to a curve of radius 440.74' and a central angle of 12°10ʹ17"; thence along the arc of the said curve of curve length 93.63'; said curve having a chord bearing and length of N 44°31ʹ47" W and 93.45'; thence a Bearing of N 50°36ʹ55" W and Distance of 33.93'; to a curve of radius 63.66' and a central angle of 64°03ʹ55"; thence along the arc of the said curve of curve length 71.18'; said curve having a chord bearing and length of N 82°38ʹ53" W and 67.53'; thence a Bearing of N 44°59ʹ02" W and Distance of 60.99'; thence a Bearing of S 49°28ʹ36" W and Distance of 193.40'; thence a Bearing of N 40°53ʹ01" W and Distance of 267.47' back to the point of beginning. Said tract contains 1.793 acres of land.

Tract "B"
To reach the point of beginning, commence at a concrete marker found monumenting the Northwest corner of tract owned by the Department of Transportation; thence a Bearing of S 40°53ʹ01" E and Distance of 267.47' to the point of beginning; thence a Bearing of N 49°28ʹ36" E and Distance of 193.40'; thence a Bearing of S 44°59ʹ02" E and Distance of 60.99'; to a curve of radius 63.66' and a central angle of 16°10ʹ22"; thence along the arc of the said curve of curve length 17.97'; said curve having a chord bearing and length of S 57°13ʹ59" W and 17.91'; thence a Bearing of S 49°08ʹ48" W and Distance of 180.03'; thence a Bearing of N 40°53ʹ01" W and Distance of 59.42' back to the point of beginning. Said tract contains 0.264 acres of land.

Tract "C"
To reach the point of beginning, commence at a concrete marker found monumenting the Northwest corner of tract owned by the Department of Transportation; thence a Bearing of S 40°53ʹ01" E and Distance of 267.47'; thence a Bearing of S 40°53ʹ01" E and Distance of 59.42'; thence a Bearing of S 40°51ʹ25" E and Distance of 33.21' to the point of beginning; thence a Bearing of N 49°08ʹ52" E and Distance of 156.73'; to a curve of radius 59.07' and a central angle of 56°06ʹ50"; thence along the arc of the said curve of curve length 57.85'; said curve having a chord bearing and length of N 77°12ʹ17" E and 55.56'; thence a Bearing of S 74°44ʹ19" E and Distance of 4.23'; to a curve of radius 121.91' and a central angle of 35°55ʹ27"; thence along the arc of the said curve of curve length 76.43'; said curve having a chord bearing and length of S 56°46ʹ35" E and 75.19'; thence a Bearing of S 38°48ʹ52" E and Distance of 88.30'; to a curve of radius 286.48' and a central angle of 10°02ʹ30"; thence along the arc of the said curve of curve length 50.21'; said curve having a chord bearing and length of S 43°50ʹ07" E and 50.14'; thence a Bearing of S 13°34ʹ07" W and Distance of 156.08'; thence a Bearing of N 40°07ʹ27" W and Distance of 107.72'; thence a Bearing of S 43°15ʹ32" W and Distance of 22.26'; thence a Bearing of S 49°07ʹ35" W and Distance of 80.49'; thence a Bearing of N 40°51ʹ25" W and Distance of 225.68' back to the point of beginning. Said tract contains 1.317 acres of land.

Tract "D"
To reach the point of beginning, commence at a concrete marker found monumenting the Northwest corner of tract owned by the Department of Transportation; thence a Bearing of S 40°53ʹ01" E and a Distance of 267.47'; thence a Bearing of S 40°53ʹ01" E and a Distance of 59.42'; thence a Bearing of S 40°51ʹ25" E and a Distance of 33.21'; thence a Bearing of S 40°51ʹ25" E and a Distance of 225.68' to the point of beginning; thence a Bearing of N 49°07ʹ35" E and Distance of 80.49'; thence a Bearing of N 43°15ʹ32" E and Distance of 22.26'; thence a Bearing of S 40°07ʹ27" E and Distance of 107.72'; thence a Bearing of S 13°34ʹ07" W and Distance of 224.36'; thence a Bearing of N 9°24ʹ09" E and Distance of 66.40'; to a curve of radius 83.66' and a central angle of 50°15ʹ34"; thence along the arc of the said curve of curve length 73.39'; said curve having a chord bearing and length of N 15°43ʹ38" W and 71.06'; thence a Bearing of N 40°51ʹ25" W and Distance of 129.14' back to the point of beginning. Said tract contains 0.345 acres of land.

(3) Said property is under the custody and control and was used by the Georgia Department of Transportation as a District Office building;
(4) The above-described property was conveyed to the State Highway Board of Georgia in May, 1932, from the City of Thomaston, Georgia, for a consideration of $5.00 and other good and valuable consideration; and
(5) Upson County is desirous of acquiring the above-described property for public purpose.

NOW, THEREFORE, BE IT RESOLVED AND ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:

SECTION 1.
That the Department of Transportation, an agency of the State of Georgia, is the owner of the above-described City of Thomaston, Upson County, Georgia real property.

SECTION 2.
That the above-described real property may be conveyed by appropriate instrument to Upson County for a consideration of $1.00, so long as the property is used for public purpose, and such further consideration and provision as the Department of Transportation shall in its discretion determine to be in the best interests of the State of Georgia.

SECTION 3.
That the Department of Transportation is authorized and empowered to do all acts and things necessary and proper to effect such conveyance.

SECTION 4.
That the deed of conveyance shall be recorded by the grantee in the Superior Court of Upson County, Georgia and a recorded copy shall be forwarded to the Department of Transportation.

SECTION 5.
That custody of the above-described property shall remain in the Department of Transportation until the property is conveyed.

SECTION 6.
That this resolution shall become effective upon its approval by the Governor or upon its becoming law without such approval.

SECTION 7.
That all laws and parts of laws in conflict with this resolution are repealed.
