RESOLUTION
Proposing
an amendment to the Constitution so as to provide that the General Assembly
shall be authorized to enact legislation and appropriate funds necessary to
provide for retirement credit for retired members of the Peace Officers´
Annuity and Benefit Fund for service rendered prior to January 1, 1976; to
provide that such legislation may provide for membership in such fund for peace
officers who rendered service as a peace officer prior to January 1, 1976, but
who are not members of the fund on July 1, 2009; to provide for the submission
of this amendment for ratification or rejection; and for other
purposes.
BE
IT RESOLVED BY THE GENERAL ASSEMBLY OF GEORGIA:
SECTION
1.
Article
III, Section VI, Paragraph VI, of the Constitution of Georgia is amended by
redesignating the second subparagraph (g) as subparagraph (h) and inserting at
the end thereof a new subparagraph to read as follows:
"(i)
The General Assembly is authorized to enact legislation and to appropriate funds
providing for retirement credit for retired members of the Peace Officers´
Annuity and Benefit Fund for prior service as a peace officer in the State of
Georgia rendered prior to January 1, 1976. Such legislation may provide for
membership in such fund for peace officers who rendered service as a peace
officer prior to January 1, 1976, who are no longer active peace officers and
who are not members of the fund."
SECTION
2.
The
above proposed amendment to the Constitution shall be published and submitted as
provided in Article X, Section I, Paragraph II of the Constitution. The ballot
submitting the above proposed amendment shall have written or printed thereon
the following:

( ) NO

Shall
the Constitution of Georgia be amended so as to provide that the General
Assembly shall be authorized to enact legislation and appropriate funds
providing for retirement credit for retired members of the Peace Officers´
Annuity and Benefit Fund for prior service as a peace officer rendered prior to
January 1, 1976, and to provide for membership for inactive peace officers who
rendered service prior to January 1, 1976?"

All
persons desiring to vote in favor of ratifying the proposed amendment shall vote
"Yes." All persons desiring to vote against ratifying the proposed amendment
shall vote "No." If such amendment shall be ratified as provided in said
Paragraph of the Constitution, it shall become a part of the Constitution of
this state.
