The Senate Public Safety and Homeland Security Committee offered the following substitute to SB 77:

A BILL TO BE ENTITLED
AN ACT

To amend Article 3A of Chapter 2 of Title 40 of the Official Code of Georgia Annotated, relating to reciprocal agreements for registration of commercial vehicles, so as to direct county tag agents to register vehicles under the International Registration Plan; to provide for the issuance of temporary permits for renewals and transfers; to provide for related matters; to provide for an effective date; to repeal conflicting laws; and for other purposes.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:

SECTION 1.

Article 3A of Chapter 2 of Title 40 of the Official Code of Georgia Annotated, relating to reciprocal agreements for registration of commercial vehicles, is amended by revising the introductory language of subsection (d) of Code Section 40-2-88, relating to reciprocal agreements for registration of commercial vehicles on apportionment basis, as follows:
"(d) The provisions of Code Sections Section 40-2-9, 40-2-22, 40-2-23, 40-2-24 and 40-2-26 shall not apply to vehicles registered under this Code section, except that:"

SECTION 2.
Said article is further amended by adding a new Code section to read as follows:
"40-2-88.1.
(a) Notwithstanding any other provisions of this chapter, county tag agents, commencing September 1, 2007, may accept and process commercial vehicle registration on either the full or apportionment basis under the International Registration Plan. The county tag agent may assist the applicant in completing the application form.
(b) An applicant registering with the county tag agent of his or her residence shall present a properly completed application form along with the amount of the license fee and all ad valorem taxes due thereon plus an administrative fee, to be retained by the county tag agent, not to exceed $25.00.
(c)(1) A temporary operating permit may be issued upon presentation of a completed application for initial registration or renewal registration together with the appropriate licensee fee in accordance with Code Section 40-2-88 for any commercial vehicle, or combination of commercial vehicles, which could be lawfully operated in the state if full registration or apportioned registration were obtained.
(2) A person who has filed his or her registration either at the county tag office or electronically and desires a temporary operating permit shall make application therefor as prescribed by the commissioner.
(3) The county tag agent may deliver the temporary operating permit at the time of registration by hand delivery at the county tag office, or electronically, or by express mail at the expense of the applicant.
(4) Temporary operating permits shall be issued for the sum of $3.00 per commercial vehicle.
(5) A temporary operating permit may be valid for any length of time; provided, however, that in no event shall the total number of days of all temporary operating permits issued for a vehicle exceed 30 days from the registration application filing date.
(d) The department shall commence to initiate an electronic filing system for registration of commercial vehicles under the International Registration Plan by January 1, 2008.
(e) The department is authorized and empowered to promulgate and enforce such rules and regulations including, without limitation, rules and regulations providing for appointment and regulation of county tag agents and the use of electronic and direct registration methods and to publish such forms as may be necessary to carry out the provisions of this Code section."

SECTION 3.
This Act shall become effective on July 1, 2007.

SECTION 4.
All laws and part of law in conflict with this Act are repealed.
