A BILL TO BE ENTITLED
AN ACT


To amend Chapter 3 of Title 12 of the Official Code of Georgia Annotated, relating to parks, historic areas, memorials, and recreation, so as to prohibit construction of new private residential housing on certain state-owned lands; to prevent impairment of obligations of contracts; to provide an effective date; to repeal conflicting laws; and for other purposes.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:

SECTION 1.
Chapter 3 of Title 12 of the Official Code of Georgia Annotated, relating to parks, historic areas, memorials, and recreation, is amended by adding a new Code section to read as follows:
"12-3-10.2.
(a) On and after the effective date of this Code section, no new private residential housing, whether single-family or multi-family, including but not limited to any condominiums that may be utilized for permanent residences, shall be built on any state-owned land that is part of the state park system constituted by Code Section 12-3-31.
(b) This Code section shall not be applied to impair an obligation of any contract entered into prior to the effective date of this Code section or any renewal of such contract."

SECTION 2.
Said chapter is further amended by adding a new Code section to read as follows:
"12-3-244.1.
(a) On and after the effective date of this Code section, no new private residential housing, whether single-family or multi-family, including but not limited to any condominiums that may be utilized for permanent residences, shall be built on any state-owned land that is leased to the Jekyll Island—State Park Authority pursuant to Code Section 12-3-241.
(b) This Code section shall not be applied to impair an obligation of any contract entered into prior to the effective date of this Code section or any renewal of such contract."
SECTION 3.
This Act shall become effective upon its approval by the Governor or upon its becoming law without such approval.

SECTION 4.
All laws and parts of laws in conflict with this Act are repealed.
