BILL TO BE ENTITLED
AN ACT
AN ACT
To
amend Chapter 14 of Title 43 of the Official Code of Georgia Annotated, relating
to electrical contractors, plumbers, conditioned air contractors, low-voltage
contractors, and utility contractors, so as to revise the definition of a
certain term for purposes of clarification; to revise provisions pertaining to
unlawful contracts with utility contractors for purposes of clarification; to
provide for related matters; to repeal conflicting laws; and for other
purposes.
BE
IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
SECTION
1.
Chapter
14 of Title 43 of the Official Code of Georgia Annotated, relating to electrical
contractors, plumbers, conditioned air contractors, low-voltage contractors, and
utility contractors, is amended by revising paragraph (17) of Code Section
43-14-2, relating to definitions, as follows:
"(17)
'Utility system' means:
(A)
Any system at least five feet underground, when installed or accessed by
trenching, open cut, cut and cover,
horizontal or
vertical drilling or boring, or other
similar construction methods which install or access the system from the ground
surface, including, but not limited to, gas distribution systems, electrical
distribution systems, communication systems,
ground-water
systems, water supply systems,
well-water
supply systems, and sanitary sewerage and
drainage systems
for which a
fee or price is paid for said service, product, or commodity or for the disposal
of said service, product, or commodity;
and
or
(B)
Reservoirs and filtration plants, water and waste-water treatment plants,
leachate collection and treatment systems associated with landfills,
lift
stations, and pump stations, when the
system distributes or collects a service, product, or commodity for which a fee
or price is paid for said service, product, or commodity or for the disposal of
said service, product, or commodity."
SECTION
2.
Said
chapter is further amended by revising subsection (h) of Code Section 43-14-8.2,
relating to utility contractor licenses, utility managers, business entities,
severance of connection with utility managers, and unlawful contracts, as
follows:
"(h)
It shall be unlawful for any
person to
contract with any other person
owner, general
contractor, or utility contractor to allow a person or entity to bid, propose,
or contract for the performance of utility
contracting work
who is
known by
when
such
person
owner, general
contractor, or utility contractor knows that such person or entity
does not
to
have a current, valid license as a utility contractor pursuant to this
chapter."
SECTION
3.
All
laws and parts of laws in conflict with this Act are repealed.
