A BILL TO BE ENTITLED
AN ACT


To amend Chapter 2 of Title 25 of the Official Code of Georgia Annotated, relating to the regulation of fire and other hazards to persons and property, so as to provide an exemption for model rockets when defining "explosive" for certain purposes; to repeal conflicting laws; and for other purposes.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:

SECTION 1.
Chapter 2 of Title 25 of the Official Code of Georgia Annotated, relating to the regulation of fire and other hazards to persons and property, is amended by revising subsection (a) of Code Section 25-2-17, relating to regulation of explosives, as follows:
"(a) As used in this Code section, the term 'explosive' or 'explosives' means any chemical compound or mechanical mixture which is commonly used or intended for the purpose of producing an explosion, which compound or mixture contains any oxidizing and combustible units or other ingredients in such proportions, quantities, or packing that an ignition by fire, by friction, by concussion, by percussion, or by detonator of any part of the compound or mixture may cause such a sudden generation of highly heated gases that the resultant gaseous pressures are capable of producing destructive effects on contiguous objects or of destroying life or limb. The term explosive shall not include model rockets or model rocket engines for propelling recoverable aero models up to a maximum loaded propellant weight of 18 pounds. Explosives constitute a special hazard to life and safety of persons because of the danger incident to their manufacture, transportation, use, sale, and storage."

SECTION 2.
All laws and parts of laws in conflict with this Act are repealed.
