A BILL TO BE ENTITLED
AN ACT


To amend Code Section 42-5-35 of the Official Code of Georgia Annotated, relating to the conferral of police powers by the commissioner of the Department of Corrections, so as to provide that certified correctional employees of the Department of Corrections who leave the department under certain conditions may retain their badges; to repeal conflicting laws; and for other purposes.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:

SECTION 1.
Code Section 42-5-35 of the Official Code of Georgia Annotated, relating to the conferral of police powers by the commissioner of the Department of Corrections, is amended by adding a new subsection as follows:
"(c) Correctional employees leaving the service of the department under honorable conditions who have accumulated 25 or more years of service with the department as a certified peace officer shall be entitled as a part of such employee´s compensation to retain his or her department issued badge. If a correctional employee serving in a certified position leaves the service of the department due to a disability that arose in the line of duty and the disability prevents the employee from working as a law enforcement officer, then the employee shall be entitled as part of such employee´s compensation to retain his or her department issued badge regardless of his or her number of years of service with the department. The board is authorized to promulgate rules and regulations for the implementation of this subsection."

SECTION 2.
All laws and parts of laws in conflict with this Act are repealed.
