A BILL TO BE ENTITLED
AN ACT


To amend Part 1 of Article 2 of Chapter 8 of Title 12 of the Official Code of Georgia Annotated, relating to general provisions relative to solid waste management, so as to repeal certain provisions relating to municipal solid waste disposal facility sites near adjoining counties; to provide restrictions on landfill sites near adjoining counties; to provide an effective date; to provide for applicability; to repeal conflicting laws; and for other purposes.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:

SECTION 1.
Part 1 of Article 2 of Chapter 8 of Title 12 of the Official Code of Georgia Annotated, relating to general provisions relative to solid waste management, is amended by repealing and reserving Code Section 12-8-25, relating to municipal solid waste disposal facility sites near adjoining counties, and by adding a new Code section to read as follows:
"12-8-25.6.
To encourage cooperation among the various counties, no new permit for a landfill or modification of an existing permit for the expansion of a landfill shall be issued if any part of the site for such landfill is within two miles of the boundaries of any adjoining county in this state without the applicant´s first receiving the express approval of the governing authority of that adjoining county."

SECTION 2.
This Act shall become effective upon its approval by the Governor or upon its becoming law without such approval and shall apply to all applications for new permits or modifications of existing permits filed on or after such effective date.

SECTION 3.
All laws and parts of laws in conflict with this Act are repealed.
