The Honorable Bill Heath State Senator
State Capitol, Room 109
Atlanta, Georgia 30334

SUBJECT: State Auditor’s Certification
Senate Bill 161 (LC 21 9237)

Dear Senator Heath:

This bill would amend provisions relating to disability benefits under the Employees’ Retirement System. Specifically, this bill would revise certain provisions relating to the handling of medical examinations that are required of all persons who are receiving disability benefits, but who have not yet attained retirement age. Additionally, this bill would provide that disability benefits paid to certain members would be reduced in an amount equal to the workers’ compensation benefits that such member receives based on a disability. Such reduction in benefits would only apply to members who first or again become a member of the Employees’ Retirement System on or after July 1, 2007.

This is to certify that this is a nonfiscal retirement bill as defined in the Public Retirement Systems Standards Law.

Respectfully,

/s/ Russell W. Hinton
State Auditor
