The Senate Health and Human Services Committee offered the following substitute to SB 155:

A BILL TO BE ENTITLED
AN ACT

To amend Part 3 of Article 16 of Chapter 2 of Title 20 of the Official Code of Georgia Annotated, relating to student health in elementary and secondary education, so as to require immunization against human papilloma virus for female students entering the sixth grade; to provide for a beginning date for certain requirements; to provide for a sunset for certain requirements; to provide for related matters; to repeal conflicting laws; and for other purposes.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:

SECTION 1.
Part 3 of Article 16 of Chapter 2 of Title 20 of the Official Code of Georgia Annotated, relating to student health in elementary and secondary education, is amended by revising subsection (c) of Code Section 20-2-771, relating to immunization of students, as follows:
"(c) The Department of Human Resources shall promulgate rules and regulations specifying those diseases against which immunization is required and the standards for such immunizations. Beginning during the 2008-2009 school year prior to admission into the sixth grade at any school in this state, all female students must be vaccinated for human papilloma virus except as otherwise provided in subsection (e) of this Code section. In the case that the federal government determines that the human papilloma virus vaccine is to be recalled or the department determines that there is a shortage of the human papilloma virus vaccine, any requirement for such vaccine pursuant to this subsection shall be suspended. Any requirement for the human papilloma virus vaccine pursuant to this subsection shall expire on July 1, 2011. The school or facility shall maintain on file the certificates of immunization for all children attending the school or facility. All facilities shall file a report annually with the Department of Human Resources. The report shall be filed on forms prepared by the Department of Human Resources and shall state the number of children attending the school or facility, the number of children who did not submit certificates of immunization within the waiver period, and the number of children who are exempted from the certification requirement for medical or religious reasons."

SECTION 2.
All laws and parts of laws in conflict with this Act are repealed.
