Senator Smith of the 52nd offered the following amendment:
Amend
the House substitute to Senate Bill 145 (SB145/HCSFA) by striking lines 26
through 31 of page 4 and inserting in lieu thereof the following:
(c)
If the jury is unable to reach a unanimous verdict as to sentence, the judge
shall dismiss the jury and shall impose a sentence of either life imprisonment
or imprisonment for life without
parole."
