A BILL TO BE ENTITLED
AN ACT


To amend Code Section 17-6-1 of the Official Code of Georgia Annotated, relating to where offenses are bailable, procedure, schedule of bails, and appeal bonds, so as to provide for certain additional conditions for bail for sexual offenses; to provide for other related matters; to repeal conflicting laws; and for other purposes.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:

SECTION 1.
Code Section 17-6-1 of the Official Code of Georgia Annotated, relating to where offenses are bailable, procedure, schedule of bails, and appeal bonds, is amended in subsection (f) by adding a new paragraph to read as follows:
"(6) For offenses involving violations of Chapter 6 of Title 16, relating to sexual offenses, bail or other pretrial release from custody shall be set by a judge on an individual basis and not a schedule of bail as provided for in paragraph (1) of this subsection. Unless the court determines that contact would be in the best interest of the victim, the court shall include as a condition of bail or pretrial release that the defendant shall not have contact of any kind or character with the victim or any member of the victim´s family or household and shall not physically abuse or threaten to physically abuse the victim."

SECTION 2.
All laws and parts of laws in conflict with this Act are repealed.
