RESOLUTION
Creating
the House Study Committee on DeKalb County Court Fines and Fees; and for other
purposes.
WHEREAS,
DeKalb County has a need to provide for additional technology for its criminal
justice programs; and
WHEREAS,
many counties have funded court technology through the use of additional fines
or fees on civil and criminal cases in the various county courts;
and
WHEREAS,
as a result of the convenience of this method of funding programs, over the
years, the additional fines and fees imposed in civil and criminal cases have
become somewhat overwhelming; and
WHEREAS,
while this may be the most appropriate means for funding the needed improvements
in technology for DeKalb County courts, it is a matter which is deserving of
study before moving forward on such measures.
NOW,
THEREFORE, BE IT RESOLVED BY THE HOUSE OF REPRESENTATIVES that there is created
the House Study Committee on DeKalb County Court Fines and Fees to be composed
of 12 members. Five of the members shall be the chairperson of the DeKalb
County delegation in the House of Representatives or his or her designee and
four other members of the House appointed by such chairperson. The other
members shall be the District Attorney of DeKalb County or his or her designee,
the Sheriff of DeKalb County or his or her designee, the Clerk of the State
Court of DeKalb County or his or her designee, the Clerk of the Superior Court
of DeKalb County or his or her designee, the chief judge of the Recorders Court
of DeKalb County or his or her designee, the chief executive officer of DeKalb
County or his or her designee, and the presiding officer of the Board of
Commissioners of DeKalb County or his or her designee. The chairperson of the
DeKalb County delegation or his or her designee shall serve as chairperson of
the committee. The chairperson shall call all meetings of the
committee.
BE
IT FURTHER RESOLVED that the committee shall undertake a study of the
conditions, needs, issues, and problems mentioned above or related thereto and
recommend any actions or legislation that the committee deems necessary or
appropriate. The committee may conduct such meetings at such places and at such
times as it may deem necessary or convenient to enable it to exercise fully and
effectively its powers, perform its duties, and accomplish the objectives and
purposes of this resolution. The legislative members of the committee shall
receive the allowances authorized for legislative members of interim legislative
committees but shall receive the same for not more than five days unless
additional days are authorized. The other members of the committee shall serve
without compensation. The funds necessary to carry out the provisions of this
resolution shall come from the funds appropriated to the House of
Representatives. In the event that the committee makes a report of its findings
and recommendations with suggestions for proposed legislation, if any, such
report shall be made on or before December 31, 2008. The committee shall stand
abolished on December 31, 2008.
