RESOLUTION
Proposing
an amendment to the Constitution so as to provide that the General Assembly may
by general law provide for the dedication and deposit of revenues from specified
sources for the purposes of the fund into a Trauma Care Trust Fund; to provide
that moneys in the fund shall be used exclusively for support of a state-wide
trauma network to ensure all Georgians have access to lifesaving trauma care in
the event of a life-threatening injury; to provide that contributions and
revenues deposited into the fund shall not be subject to the lapsing provisions
of the Constitution; to provide for the submission of this amendment for
ratification or rejection; and for other purposes.
BE
IT RESOLVED BY THE GENERAL ASSEMBLY OF GEORGIA:
SECTION
1.
Article
III, Section IX, Paragraph VI of the Constitution is amended by inserting a new
subparagraph to read as follows:
"(o)
The General Assembly is authorized to provide by general law for the creation of
a Trauma Care Trust Fund. Any hospital, hospital authority, county, or
municipality is authorized to contribute or transfer moneys to the fund, and any
other person or entity specified by the General Assembly may also contribute to
the fund. The General Assembly may provide by general law for the dedication
and deposit of revenues raised from specified sources for the purposes of the
fund into the fund. Moneys in the fund shall be used exclusively for trauma
care programs to support designated trauma centers, physicians caring for trauma
patients, emergency medical services transportation of trauma patients, air
ambulance support for trauma patients, rehabilitation services, data collection,
and injury prevention education and research and to provide for development of a
state-wide trauma network to serve all persons in the event of a traumatic
injury. Any other appropriation from the Trauma Care Trust Fund shall be void.
Notwithstanding the provisions of subparagraph (a) of this Paragraph, the
General Assembly is authorized to designate one or more sources of revenue to be
paid into the fund. Moneys paid into the fund shall not be subject to the
provisions of Article III, Section IX, Paragraph IV(c), relative to the lapsing
of funds."
SECTION
2.
The
above proposed amendment to the Constitution shall be published and submitted as
provided in Article X, Section I, Paragraph II of the Constitution. The ballot
submitting the above proposed amendment shall have written or printed thereon
the following:

Shall
the Constitution of Georgia be amended so as to authorize the General Assembly
to provide by general law for the dedication and deposit of revenues raised from
specified sources for the purposes of the fund into a Trauma Care Trust Fund; to
provide that moneys in the fund shall be used exclusively for trauma care
programs to support designated trauma centers, physicians caring for trauma
patients, emergency medical services transportation of trauma patients, air
ambulance support for trauma patients, rehabilitation services, data collection,
and injury prevention education and research; to provide for development of a
state-wide trauma network to serve all persons in the event of a traumatic
injury; and to provide that contributions and revenues deposited to the fund
shall not lapse?"

All
persons desiring to vote in favor of ratifying the proposed amendment shall vote
"Yes." All persons desiring to vote against ratifying the proposed amendment
shall vote "No." If such amendment shall be ratified as provided in said
Paragraph of the Constitution, it shall become a part of the Constitution of
this state.
