A BILL TO BE ENTITLED
AN ACT


To amend Part 8 of Article 1 of Chapter 11 of Title 15 and Article 1 of Chapter 4 of Title 17 of the Official Code of Georgia Annotated, relating to access to records and hearings and general provisions of arrest of persons, respectively, so as to require certain courts to notify school superintendents of certain information under certain circumstances; to provide for related matters; to repeal conflicting laws; and for other purposes.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:

SECTION 1.
Part 8 of Article 1 of Chapter 11 of Title 15 of the Official Code of Georgia Annotated, relating to access to records and hearings, is amended by adding a new Code section to read as follows:
"15-11-84.
When a court enters any order regarding a child who is charged with an act which would be a felony or misdemeanor if committed by an adult, other than a traffic offense or juvenile traffic offense as such term is defined in Code Section 15-11-73, or when a child is adjudicated for an act which would be a felony or misdemeanor if committed by an adult, other than a traffic offense or juvenile traffic offense as such term is defined in Code Section 15-11-73, in addition to the other notification requirements provided for by this chapter, the court shall provide written notice of such child´s name, address, and act charged or adjudicated to the school superintendent or his or her designee of the school district in which such child resides or would attend school by virtue of the child´s address. Such information may be disseminated by the appropriate school superintendent to the child´s teachers and counselors in the superintendent´s discretion. A local school system to which the child is assigned may request further information from the court´s file upon a showing that it is necessary in the public interest."

SECTION 2.
Article 1 of Chapter 4 of Title 17 of the Official Code of Georgia Annotated, relating to general provisions of arrest of persons, is amended by adding a new Code section to read as follows:
"17-4-4.
When a person under 21 years of age who is currently enrolled in secondary school is convicted of a felony or misdemeanor, other than a traffic offense, the sentencing court shall provide written notice of such person´s name, address, and the offense for which he or she was convicted to the school superintendent or his or her designee of the school district in which such person resides or would attend school by virtue of the person´s address. Such information may be disseminated by the appropriate school superintendent to the person´s teachers and counselors in the superintendent´s discretion."

SECTION 3.
All laws and parts of laws in conflict with this Act are repealed.
