A BILL TO BE ENTITLED
AN ACT


To amend Part 5 of Article 22 of Chapter 2 of Title 20 of the Official Code of Georgia Annotated, relating to school buses, so as to prohibit the use of a cellular phone and other communication devices by a school bus driver except for official school system business or in the event of an emergency; to provide for related matters; to repeal conflicting laws; and for other purposes.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:

SECTION 1.
Part 5 of Article 22 of Chapter 2 of Title 20 of the Official Code of Georgia Annotated, relating to school buses, is revised by adding a new Code section to read as follows:
"20-2-1127.
(a) The use of a mobile, wireless, or cellular phone or other communication device by a school bus driver while there are one or more children or other passengers on the school bus shall be prohibited.
(b) Any school bus driver found to be in violation of this Code section shall be subject to disciplinary action by the local board of education, up to and including termination from employment.
(c) This Code section shall not prohibit any school bus driver from using a mobile, wireless, or cellular phone or other communication device provided or allowed by the public school system for necessary official school system business or in the event of an emergency."

SECTION 2.
All laws and parts of laws in conflict with this Act are repealed.
