BILL TO BE ENTITLED
AN ACT
AN ACT
To
amend Article 2 of Chapter 5 of Title 40 of the Official Code of Georgia
Annotated, relating to issuance, expiration, and renewal of motor vehicle
drivers´ licenses, so as to authorize issuance of Class C drivers´
licenses to persons who are prohibited from driving commercial motor vehicles
under certain circumstances; to provide for surrender of such Class C licenses
prior to resuming driving commercial motor vehicles; to repeal conflicting laws;
and for other purposes.
BE
IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
SECTION
1.
Article
2 of Chapter 5 of Title 40 of the Official Code of Georgia Annotated, relating
to issuance, expiration, and renewal of motor vehicle drivers´ licenses, is
amended by adding a new Code section to read as follows:
"40-5-22.2.
Any
resident of this state who does not drive a commercial motor vehicle due to
application of the prohibition against driving a commercial motor vehicle under
subsection (b) of Code Section 40-5-146 may be issued a Class C license under
this article during the period of such prohibition if he or she otherwise
qualifies for a Class C license and conviction of the offense that resulted in
application of subsection (b) of Code Section 40-5-146 would not have resulted
in the suspension or revocation of a Class C driver´s license under Article
3 of this chapter if he or she had held such a license at the time of the
offense; provided, however, that Code Section 40-5-143 shall apply, and any
Class C license issued under this Code section shall be surrendered to the
department prior to such person´s resuming driving any commercial motor
vehicle."
SECTION
2.
All
laws and parts of laws in conflict with this Act are repealed.
