BILL TO BE ENTITLED
AN ACT
AN ACT
To
amend Chapter 1 of Title 33 of the Official Code of Georgia Annotated, relating
to general provisions of insurance, so as to provide that an insurer may provide
insurance policies and other information in a language other than English; to
provide in the event of a dispute or complaint arising involving material not in
English, the English version of the material will control the resolution of the
dispute or complaint; to provide for related matters; to repeal conflicting
laws; and for other purposes.

IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
SECTION
1.
Chapter
1 of Title 33 of the Official Code of Georgia Annotated, relating to general
provisions of insurance, is amended by adding Code Section 33-1-19 to read as
follows:
"33-1-19.
(a)
An insurer, as defined in paragraph (4) of Code Section 33-1-2, may conduct
transactions in a language other than English through an employee or agent
acting as interpreter or through an interpreter provided by the customer,
insurer, or agent.
(b)
An insurer may provide insurance policies, endorsements, riders, explanatory
details, or advertising material in a language other than English. In the event
of a dispute or complaint wherein the insurer provided any material in a
language other than English, the English language version of the policy as
defined in paragraph (1) of Code Section 33-24-1 shall control the resolution of
the dispute or complaint."
SECTION
2.
All
laws and parts of laws in conflict with this Act are repealed.
