A BILL TO BE ENTITLED
AN ACT


To amend Chapter 80 of Title 36 of the Official Code of Georgia Annotated, relating to general provisions applicable to counties, municipal corporations, and other government entities, so as to prohibit local governments from requiring transfer of the ownership of privately constructed water or sewage systems under certain conditions; to provide for related matters; to provide an effective date; to repeal conflicting laws; and for other purposes.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:

SECTION 1.
Chapter 80 of Title 36 of the Official Code of Georgia Annotated, relating to general provisions applicable to counties, municipal corporations, and other government entities, is amended by adding a new Code section to read as follows:
"36-80-21.
Notwithstanding any other provision of law to the contrary, no municipal corporation, county, or local authority shall require the transfer of ownership of a privately constructed water or sewage system that is not to be connected to a publicly owned water or sewage system to said governmental entity; nor shall such governmental entity require such transfer of ownership as a condition for the approval or issuance of local permits."

SECTION 2.
This Act shall become effective upon its approval by the Governor or upon its becoming law without such approval.

SECTION 3.
All laws and parts of laws in conflict with this Act are repealed.
