BILL TO BE ENTITLED
AN ACT
AN ACT
To
amend Chapter 13 of Title 16 of the Official Code of Georgia Annotated, relating
to controlled substances, so as to change certain provisions relating to
Schedule II controlled substances; to change certain provisions relating to
Schedule V controlled substances; to change certain provisions relating to the
definition of "dangerous drug"; to provide an effective date; to repeal
conflicting laws; and for other purposes.

IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
SECTION
1.
Chapter
13 of Title 16 of the Official Code of Georgia Annotated, relating to controlled
substances, is amended in Code Section 16-13-26, related to Schedule II
controlled substances, by striking in its entirety subparagraph (G) of paragraph
(3) which reads as follows:

Said
chapter is further amended in Code Section 16-13-29, relating to Schedule V
controlled substances, by revising paragraph (3) as follows:

Said
chapter is further amended in Code Section 16-13-71, relating to the definition
of dangerous drug, by adding a new paragraph to subsection (c) as
follows:
"(12.7)
Ketotifen – when used with a strength of 0.025 percent or less in an
ophthalmic soultion;"

Said
chapter is further amended in Code Section 16-13-71, relating to the definition
of dangerous drug, by adding a new subsection (f) to read as
follows:
"(f)
Levonorgestrel, where a single dose is 0.75 mg. per dosage unit only, can be
sold without a prescription or over the counter, and such sales to the public
are restricted only to licensed pharmacies with the drug required to be kept
behind the prescription counter and can only be sold when a pharmacist is on
duty with the following additional restrictions:
(1)
The product packaging contains only two dosages units;
(2)
The product is available in packages of two dosage units only;
(3)
The product is sold without a prescription only to persons 18 years of age or
older;
(4)
The product packaging is labeled 'Rx only for age 17 and younger';
and
(5)
The person obtaining the product must present valid
identification."
SECTION
7.
This
Act shall become effective upon its approval by the Governor or upon its
becoming law without such approval.
SECTION
8.
All
laws and parts of laws in conflict with this Act are repealed.
