A BILL TO BE ENTITLED
AN ACT


To amend Chapter 13 of Title 16 of the Official Code of Georgia Annotated, relating to controlled substances, so as to change certain provisions relating to Schedule II controlled substances; to change certain provisions relating to Schedule V controlled substances; to change certain provisions relating to the definition of "dangerous drug"; to provide an effective date; to repeal conflicting laws; and for other purposes.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:

SECTION 1.
Chapter 13 of Title 16 of the Official Code of Georgia Annotated, relating to controlled substances, is amended in Code Section 16-13-26, related to Schedule II controlled substances, by striking in its entirety subparagraph (G) of paragraph (3) which reads as follows:
"(G) Dimethylamphetamine;"

SECTION 2.
Said chapter is further amended in Code Section 16-13-29, relating to Schedule V controlled substances, by revising paragraph (3) as follows:
"(3) Reserved Pregabalin; or"

SECTION 3.
Said chapter is further amended in Code Section 16-13-71, relating to the definition of dangerous drug, by revising paragraphs (509.18), (517.5), and (772.5) in subsection (b) as follows:
"(509.18) Ketotifen – See exceptions;"
"(517.5) Levonorgestrel;"
"(772.5) Pregabalin;"
SECTION 4.
Said chapter is further amended in Code Section 16-13-71, relating to the definition of dangerous drug, by adding new paragraphs to subsection (b) to read as follows:
"(.037) Abatacept;"
"(19.75) Alglucosidase alfa;"
"(52.5) Anidulafungin;"
"(62.75) Arformoterol tartrate;"
"(101.5) Biskalcitrate;"
"(192.02) Ciclesonide;"
"(213.3) Conivaptan;"

SECTION 5.
Said chapter is further amended in Code Section 16-13-71, relating to the definition of dangerous drug, by adding a new paragraph to subsection (c) as follows:
"(12.7) Ketotifen – when used with a strength of 0.025 percent or less in an ophthalmic soultion;"
SECTION 6.
This Act shall become effective upon its approval by the Governor or upon its becoming law without such approval.

SECTION 7.
All laws and parts of laws in conflict with this Act are repealed.
