BILL TO BE ENTITLED
AN ACT
AN ACT
To
amend Chapter 75 of Title 36 of the Official Code of Georgia Annotated, relating
to war on terrorism local assistance, so as to provide for limitations with
respect to the creation, activation, and activities of public safety and
judicial facilities authorities and joint public safety and judicial facilities
authorities; to provide for legislative intent; to provide an effective date; to
repeal conflicting laws; and for other purposes.
BE
IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
SECTION
1.
Chapter
75 of Title 36 of the Official Code of Georgia Annotated, relating to war on
terrorism local assistance, is amended by adding a new Code section to read as
follows:
"36-75-11.
(a)
The General Assembly finds that the funding of public safety and judicial
facilities projects is accomplished in a more accountable and responsible manner
through the issuance of general obligation bonds approved by the voters of
affected local tax jurisdictions.
(b)
On or after the effective date of this Code section, no county or municipality
shall be authorized to activate or otherwise declare by proper ordinance or
resolution the need for a public safety and judicial facilities authority or a
joint public safety and judicial facilities authority.
(c)
On or after the effective date of this Code section, any public safety and
judicial facilities authority or joint public safety and judicial facilities
authority created and activated under Code Section 36-75-4 which has not
incurred bonded indebtedness shall be expressly prohibited from incurring bonded
indebtedness.
(d)
On or after the effective date of this Code section, any public safety and
judicial facilities authority or joint public safety and judicial facilities
authority created and activated under Code Section 36-75-4 which has incurred
bonded indebtedness shall be expressly prohibited from incurring further bonded
indebtedness."
SECTION
2.
This
Act shall become effective upon its approval by the Governor or upon its
becoming law without such approval.
SECTION
3.
All
laws and parts of laws in conflict with this Act are repealed.
