House Committee on Judiciary Non-civil offers the following substitute
to HB 1213:

BILL TO BE ENTITLED
AN ACT
AN ACT
To
amend Code Section 16-6-22 of the Official Code of Georgia Annotated, relating
to incest, so as to provide that the crime of incest includes sexual intercourse
or sodomy between persons who are related either by blood or by marriage as
father and child or stepchild, mother and child or stepchild, siblings of the
whole blood or of the half blood, aunt and niece or nephew, or uncle and niece
or nephew; to provide for related matters; to provide for an effective date and
applicability; to repeal conflicting laws; and for other purposes.
BE
IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
SECTION
1.
Code
Section 16-6-22 of the Official Code of Georgia Annotated, relating to incest,
is amended by revising subsection (a) as follows:
"(a)
A person commits the offense of incest when
the
such
person engages in sexual intercourse
or sodomy, as
such term is defined in Code Section
16-6-2, with a person to whom he or she
knows he or she is related either by blood or by marriage as
follows:
(1)
Father and
daughter
child
or
stepdaughter
stepchild;
(2)
Mother and
son
child
or
stepson
stepchild;
(3)
Brother and
sister
Siblings
of the whole blood or of the half blood;
(4)
Grandparent and grandchild;
(5)
Aunt and niece
or nephew; or
(6)
Uncle and niece
or
nephew."
SECTION
2.
This
Act shall become effective on July 1, 2008, and shall apply to all offenses
committed on and after such date.
SECTION
3.
All
laws and parts of laws in conflict with this Act are repealed.
