BILL TO BE ENTITLED
AN ACT
AN ACT
To
amend Article 4 of Chapter 8 of Title 50 of the Official Code of Georgia
Annotated, relating to metropolitan area planning and development commissions,
so as to define a certain term; to provide that no transportation plan developed
by a metropolitan area planning and development commission shall become
effective unless approved by the General Assembly; to provide for submission; to
repeal conflicting laws; and for other purposes.
BE
IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
SECTION
1.
Article
4 of Chapter 8 of Title 50 of the Official Code of Georgia Annotated, relating
to metropolitan area planning and development commissions, is amended by adding
a new Code section to read as follows:
"50-8-100.1.
(a)
No transportation plan developed and adopted through the metropolitan
transportation planning process for a metropolitan planning area shall become
effective unless approved by the General Assembly by means of the adoption of a
joint resolution ratifying such plan, except as otherwise provided by this Code
section. Each project within the plan shall contain a detailed description of
the project, the proposed cost and funding of the project, and an explanation of
why the project is necessary. The submission shall be made to a joint meeting
of the House and Senate Transportation Committees.
(b)
If the General Assembly approves the plan or approves an amended plan by
adopting a joint resolution in accordance with subsection (a) of this Code
section, or if such a resolution is not affirmatively defeated by majority vote
in both the House of Representatives and the Senate during the session in which
such a proposed plan was timely presented by the commission to the General
Assembly for approval, then the plan shall be deemed approved on July 1 next
occurring after the session in which such proposed plan was timely presented to
the General Assembly for approval. If such a resolution is affirmatively
defeated by majority vote in both the House of Representatives and the Senate,
then such plan shall not be pursued, and no action shall be taken in furtherance
of such plan."
SECTION
2.
All
laws and parts of laws in conflict with this Act are repealed.
