BILL TO BE ENTITLED
AN ACT
AN ACT
To
amend Chapter 15 of Title 19 of the Official Code of Georgia Annotated, relating
to child abuse, so as to change certain provisions relating to the county
multiagency child fatality review committee and reporting; to change
distribution of certain reports; to change certain provisions relating to the
Georgia Child Fatality Review Panel´s reporting; to provide for related
matters; to repeal conflicting laws; and for other purposes.
BE
IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
SECTION
1.
Chapter
15 of Title 19 of the Official Code of Georgia Annotated, relating to child
abuse, is amended by revising subsection (o) of Code Section 19-15-3, relating
to the county multiagency child fatality review committee and reporting, as
follows:
"(o)
Each local review committee shall issue an annual report no later than the first
day of July in 2001 and in each year thereafter. The report shall:
(1)
Specify the numbers of reports received by that review committee from a county
medical examiner or coroner pursuant to subsection (h) of this Code section for
the preceding calendar year;
(2)
Specify the number of reports of child fatality reviews prepared by the review
committee during such period;
(3)
Be published at least once annually in the legal organ of the county or counties
for which the review committee was established with the expense of such
publication paid each by such county; and
(4)
Be transmitted, no later than the fifteenth day of July in 2001 and in each year
thereafter, to the Georgia Child Fatality Review Panel
and the
Judiciary Committees of the House of Representatives and
Senate."
SECTION
2.
Said
chapter is further amended by revising subsection (i) of Code Section 19-15-4,
relating to the Georgia Child Fatality Review Panel, as follows:
"(i)
By January 1 of each calendar year, the panel shall submit a report to the
Governor, the Lieutenant Governor,
and
the Speaker of the House of
Representatives,
and the Judiciary Committees of the Senate and House of
Representatives regarding the prevalence
and circumstances of child fatalities in the state; recommend measures to reduce
such fatalities caused by other than natural causes; and address in the report
the following issues:
(1)
Whether the deaths could have been prevented;
(2)
Whether the children were known to any state or local agency;
(3)
The actions, if any, taken by any state or local agency or court;
(4)
Whether agency or court intervention could have prevented their
deaths;
(5)
Whether policy, procedural, regulatory, or statutory changes are called for as a
result of these findings; and
(6)
Whether any referral should have been made to a law enforcement agency which was
not made."
SECTION
3.
All
laws and parts of laws in conflict with this Act are repealed.
