BILL TO BE ENTITLED
AN ACT
AN ACT
To
amend Article 2 of Chapter 5 of Title 12 of the Official Code of Georgia
Annotated, relating to the control of water pollution and surface-water use, so
as to limit what restrictions the director of the Environmental Protection
Division of the Department of Natural Resources may place on public, private, or
community swimming pools under certain circumstances; to provide for related
matters; to repeal conflicting laws; and for other purposes.
BE
IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
SECTION
1.
Article
2 of Chapter 5 of Title 12 of the Official Code of Georgia Annotated, relating
to the control of water pollution and surface-water use, is amended by striking
"and" immediately after the ";" in paragraph (4) and adding a new paragraph to
subsection (l) of Code Section 12-5-31, relating to permits for the withdrawal,
diversion, or impoundment of surface waters generally, to read as
follows:
"(4.1)
When imposing any restrictions pursuant to paragraph (1) of this subsection, the
director shall not be permitted to restrict the use or maintenance of public,
private, or community swimming pools; and"
SECTION
2.
All
laws and parts of laws in conflict with this Act are repealed.
