A
RESOLUTION
Creating
the Senate Study Committee for the Creation of a Georgia MethCheck Data Base;
and for other purposes.
WHEREAS,
abuse of methamphetamine and illicit manufacture of methamphetamine have been
growing exponentially in Georgia; and
WHEREAS,
law enforcement agencies have uncovered many instances of tragic human injuries
and extensive property damages due to unlawful methamphetamine laboratories;
and
WHEREAS,
at this time the state does not have a centralized real-time electronic logbook
that can record purchases of products containing ephedrine, pseudoephedrine, and
phenylpropanolamine which are drugs used to manufacture illicit methamphetamine;
and
WHEREAS,
the failure to have such a centralized electronic data base permits and
encourages criminals to illegally purchase large quantities of such products for
the production of methamphetamine by going from store to store, and, sometimes,
from state to state; and
WHEREAS,
law enforcement officials need this critical tool to combat methamphetamine
production in this state, and the electronic documentation of purchases made at
pharmacies and retailers will stop the ever-increasing threat posed by the
illegal production of methamphetamine; and
WHEREAS,
other states are adopting similar measures, thereby encouraging methamphetamine
producers to relocate to states such as Georgia that are unable to track their
unlawful activities; and
WHEREAS,
immediate action is needed by the General Assembly to protect Georgia´s
children from the increasing harm caused by methamphetamine
producers.
NOW, THEREFORE, BE IT RESOLVED BY THE SENATE that there is created the Senate Study Committee for the Creation of a Georgia MethCheck Data Base to be composed of five members of the Senate to be appointed by the President of the Senate. The President shall designate a member of the committee as chairperson of the committee. The chairperson shall call all meetings of the committee.
NOW, THEREFORE, BE IT RESOLVED BY THE SENATE that there is created the Senate Study Committee for the Creation of a Georgia MethCheck Data Base to be composed of five members of the Senate to be appointed by the President of the Senate. The President shall designate a member of the committee as chairperson of the committee. The chairperson shall call all meetings of the committee.
BE
IT FURTHER RESOLVED that the committee shall undertake a study of the
conditions, needs, issues, and problems mentioned above or related thereto and
recommend any action or legislation which the committee deems necessary or
appropriate. The committee shall specifically consider the need for a MethCheck
Data Base, the possible operation of such a data base by the Georgia Bureau of
Investigations, and the types of information to be recorded, stored, and shared
by retailers of products containing ephedrine, pseudoephedrine, and
phenylpropanolamine. The committee may conduct such meetings at such places and
at such times as it may deem necessary or convenient to enable it to exercise
fully and effectively its powers, perform its duties, and accomplish the
objectives and purposes of this resolution. The members of the committee shall
receive the allowances provided for in Code Section 28-1-8 of the Official Code
of Georgia Annotated. The allowances authorized by this resolution shall not be
received by any member of the committee for more than five days unless
additional days are authorized. The funds necessary to carry out the provisions
of this resolution shall come from the funds appropriated to the Senate. In the
event the committee makes a report of its findings and recommendations, with
suggestions for proposed legislation, if any, such report shall be made on or
before December 31, 2008. The committee shall stand abolished on December 31,
2008.
