AN ACT

To repeal an Act incorporating and providing a charter for the Town of Weston in Webster County, approved August 12, 1911 (Ga. L. 1911, p. 1620); to thereby provide for the territory formerly included in the town to become subject to governance by the governing authority of the consolidated government of Webster County or the governing authority of Webster County, whichever may be in effect on the effective date of this Act; to provide for the devolution of all assets and obligations of the Town of Weston to the consolidated government of Webster County or the county government of Webster County, whichever may be in effect on the effective date of this Act; to provide for other related matters; to repeal conflicting laws; and for other purposes.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:

SECTION 1.
An Act incorporating and providing a charter for the Town of Weston in Webster County, approved August 12, 1911 (Ga. L. 1911, p. 1620) is repealed in its entirety.

SECTION 2.
(a) On January 1, 2009, the territory formerly included in the Town of Weston shall become subject to governance by the governing authority of the consolidated government of Webster County or the governing authority of Webster County, whichever may be in effect on such date.
(b) All assets and obligations of the Town of Weston shall devolve by operation of law to the consolidated government of Webster County or the county government of Webster County, whichever may be in effect on January 1, 2009.
(c) On and after January 1, 2009, the geographic area that was contained in the boundaries of the former Town of Weston may continue to be identified under the same name and style as the former municipal corporation, and for such purpose signs and other appropriate insignia may be erected for such identification.
(d) Prior to January 1, 2009, the governing authority of the Town of Weston and the governing authority of the consolidated government of Webster County or the county governing authority of Webster County may enter into any intergovernmental agreements which may be necessary or desirable to facilitate transitional matters.

SECTION 3.
This Act shall become effective January 1, 2009, except that subsection (d) of Section 2 of this Act shall become effective upon approval of this Act by the Governor or upon this Act's becoming law without such approval.
