A BILL TO BE ENTITLED
AN ACT


To amend Code Section 32-6-26 of the Official Code of Georgia Annotated, relating to weight of vehicle and load, so as to allow the operator of a vehicle to comply with weight requirements by shifting or equalizing the load on all wheels or axles; to provide for related matters; to provide for an effective date; to repeal conflicting laws; and for other purposes.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:

SECTION 1.
Code Section 32-6-26 of the Official Code of Georgia Annotated, relating to weight of vehicle and load, is amended by revising paragraph (1) of subsection (i) as follows:
"(i)(1) Any vehicle which can be made to comply with the requirements of this Code section by shifting the load and which is then loaded to comply with this Code section shall not be held to be in violation of this Code section If a law enforcement officer finds that the gross weight of a vehicle and its load is within the limits permitted under this Code section and does not exceed the limit for which the vehicle is registered, but that the axle weight of any axle or axles of the vehicle exceeds that permitted under this Code section, the driver of any vehicle shall be allowed to bring the vehicle into compliance with the weight requirements of this Code section by shifting or equalizing the load on all wheels or axles. If the driver brings the vehicle into compliance with this Code section when requested by the proper authority, the driver shall not be held to be operating in violation of this Code section."

SECTION 2.
This Act shall become effective on July 1, 2007.

SECTION 3.
All laws and parts of laws in conflict with this Act are repealed.
