A BILL TO BE ENTITLED
AN ACT


To amend Part 2 of Article 1 of Chapter 3 of Title 27 of the Official Code of Georgia Annotated, relating to deer and hunting of deer, so as to revise provisions relating to lawful and unlawful killing of dogs pursuing or killing deer; to provide for killing of feral dogs pursuing wildlife; to provide an effective date; to repeal conflicting laws; and for other purposes.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:

SECTION 1.
Part 2 of Article 1 of Chapter 3 of Title 27 of the Official Code of Georgia Annotated, relating to deer and hunting of deer, is amending by revising Code Section 27-3-49, relating to lawful and unlawful killing of dogs pursuing or killing deer, as follows:
"27-3-49.
(a) It shall be the duty of every conservation ranger to Wherein such activity is in accordance with the sound principles of wildlife management, the department is authorized to kill any feral dog pursuing or killing any deer wildlife in any locality other than that prescribed by law or rules and regulations permitting such hunting, and no action for damages shall be maintained against the person for such killing.
(b) It shall be unlawful for any person other than a conservation ranger, sheriff, or deputy sheriff to kill a dog wearing a collar, which dog is or has been pursuing or killing a deer.
(c) It shall not be unlawful for any person to kill a dog which does not have a collar and which is pursuing or killing deer in any locality other than that prescribed by law or rules and regulations permitting such hunting, and no action for damages shall be maintained against the person for such killing."

SECTION 2.
This Act shall become effective upon its approval by the Governor or upon its becoming law without such approval.
SECTION 3.
All laws and parts of laws in conflict with this Act are repealed.
