A RESOLUTION


Proposing an amendment to the Constitution of Georgia so as to provide that if nonresidential property is annexed into a municipality, the ad valorem school taxes on that property will remain with the county school system unless otherwise provided by the General Assembly by local Act or by agreement between the county school system and the independent school system; to provide for the submission of this amendment for ratification or rejection; and for other purposes.

BE IT RESOLVED BY THE GENERAL ASSEMBLY OF GEORGIA:

SECTION 1.
Article VIII, Section VI, Paragraph I of the Constitution is amended by revising subparagraph (a) as follows:
"(a) The board of education of each school system shall annually certify to its fiscal authority or authorities a school tax not greater than 20 mills per dollar for the support and maintenance of education. Said fiscal authority or authorities shall annually levy said tax upon the assessed value of all taxable property within the territory served by said school system, provided that the levy made by an area board of education, which levy shall not be greater than 20 mills per dollar, shall be in such amount and within such limits as may be prescribed by local law applicable thereto. Where property, other than undeveloped property, that is zoned and used solely for nonresidential purposes is annexed into a municipality with an independent school system, the ad valorem taxes levied for educational purposes on such nonresidential property shall remain with the county school system; provided, however, that for an annexation by local Act, such local Act may provide otherwise and provided that a county school system and an independent school system may provide otherwise by agreement."

SECTION 2.
The above proposed amendment to the Constitution shall be published and submitted as provided in Article X, Section I, Paragraph II of the Constitution. The ballot submitting the above proposed amendment shall have written or printed thereon the following:
"(  )  YES

(  )  NO

Shall the Constitution of Georgia be amended so as to provide that if nonresidential property is annexed into a municipality, the ad valorem school taxes on that property will remain with the county school system unless otherwise provided by the General Assembly by local Act or by agreement between the county school system and the independent school system?"
All persons desiring to vote in favor of ratifying the proposed amendment shall vote "Yes." All persons desiring to vote against ratifying the proposed amendment shall vote "No." If such amendment shall be ratified as provided in said Paragraph of the Constitution, it shall become a part of the Constitution of this state.
