A RESOLUTION


Proposing an amendment to the Constitution so as to authorize the General Assembly to provide by general law for pari-mutuel betting and casino gambling only in unincorporated areas of counties and in municipal corporations where such activities have been approved by referendum; to provide for the levy and collection of state and local taxes, fees, or assessments regarding the proceeds from such pari-mutuel betting and casino gambling; to provide for related matters; to provide for the submission of this amendment for ratification or rejection; and for other purposes.

BE IT RESOLVED BY THE GENERAL ASSEMBLY OF GEORGIA:

SECTION 1.
Article I, Section II, Paragraph VIII of the Georgia Constitution is amended by inserting a new subparagraph to be designated subparagraph (e) to read as follows:
"(e) The General Assembly may by general law provide for pari-mutuel betting or casino gambling or both pari-mutuel betting and casino gambling within the unincorporated area of a county or within a municipal corporation where such activities have been approved by majority vote of the electors of such area in a referendum held for the purpose of such approval. Pari-mutuel betting and casino gambling shall continue to be unlawful within the unincorporated area of every county and within every municipal corporation where such activities have not been approved by majority vote of the electors of such areas in a referendum. No pari-mutuel betting or casino gambling shall be owned or operated by the state or by any county, municipal corporation, consolidated government, or other governmental subdivision. The state and the governing authority of the county or municipal corporation in which pari-betting or casino gambling or both have been approved by referendum are authorized to levy and collect a tax, fee, or other assessment upon the proceeds of such betting or gambling. The General Assembly is authorized to provide by general or local law for the implementation of and for further conditions and requirements relative to this subparagraph."

SECTION 2.
The above proposed amendment to the Constitution shall be published and submitted as provided in Article X, Section I, Paragraph II of the Constitution. The ballot submitting the above proposed amendment shall have written or printed thereon the following:
"(  )  YES

(  )  NO

Shall the Constitution of Georgia be amended so as to provide for pari-mutuel betting, casino gambling, or both pari-mutuel betting and casino gambling within the unincorporated area of a county or within a municipal corporation upon the approval by a majority vote of the electors in a referendum and authorize the state and local governing authority to levy and collect taxes, fees, or assessments upon the proceeds of such activity? "
All persons desiring to vote in favor of ratifying the proposed amendment shall vote "Yes." All persons desiring to vote against ratifying the proposed amendment shall vote "No." If such amendment shall be ratified as provided in said Paragraph of the Constitution, it shall become a part of the Constitution of this state.
