A BILL TO BE ENTITLED
AN ACT


To amend Chapter 66 of Title 36 of the Official Code of Georgia Annotated, relating to zoning procedures, so as to provide that a municipal governing body shall not adopt or implement an ordinance or land use regulation in any manner that prohibits a person from engaging in the activities of an automotive collector under certain circumstances; to provide an effective date; to repeal conflicting laws; and for other purposes.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:

SECTION 1.
Chapter 66 of Title 36 of the Official Code of Georgia Annotated, relating to zoning procedures, is amended by adding a new Code section at the end thereof, to be designated Code Section 36-66-7, to read as follows:
"36-66-7.
(a) As used in this Code section, the term:
(1) 'Automotive collector' means a person who collects and restores collectible vehicles, either as a hobby or as a profession.
(2) 'Ordinary public view' means within normal visual range by a person on a public street or sidewalk adjacent to real property.
(3) 'Parts car' means an automobile that is not intended to be operated on streets and roads, but is used to provide parts for the restoration of other vehicles.
(b) A municipal governing body shall not adopt or implement an ordinance or land use regulation in any manner that prohibits a person from engaging in the activities of an automotive collector in an area zoned by the municipality, so long as any collector vehicles, including parts cars, maintained and stored by the collector are located out of ordinary public view by means of inside storage, suitable fencing, trees, shrubbery, or otherwise.
(c) A person engaged in the activities of an automotive collector may conduct mechanical repairs and modification to a vehicle located out of ordinary public view on private real property."

SECTION 2.
This Act shall become effective upon its approval by the Governor or upon its becoming law without such approval.

SECTION 3.
All laws and parts of laws in conflict with this Act are repealed.
