A BILL TO BE ENTITLED
AN ACT


To amend an Act to create an amended charter for the Town of Willacoochee, in the County of Atkinson, and to reincorporate said town as a city, and define its territorial limits, approved December 22, 1953 (Ga. L. 1953, Nov.-Dec. Sess., p. 3039), as amended, so as to deannex certain property from the corporate limits; to provide for related matters; to repeal conflicting laws; and for other purposes.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:

SECTION 1.
An Act to create an amended charter for the Town of Willacoochee, in the County of Atkinson, and to reincorporate said town as a city, and define its territorial limits, approved December 22, 1953 (Ga. L. 1953, Nov.-Dec. Sess., p. 3039), as amended, is amended by designating the existing matter contained in Section 102 as subsection (a) and adding a new subsection (b) to read as follows:
"(b) On and after the effective date of this subsection, the corporate limits of the City of Willacoochee shall not contain the following described territory:
All that tract or parcel of land situate, lying and being in Land Lot 19 and 20 of the 10th Land District and Land Lot 525 of the 5th Land District of Atkinson County, Georgia, and being more particularly described, depicted, and shown as Tract 1, containing 499.93 acres and Tract 2, containing 197.04 acres, as shown on that certain map or plat of survey entitled 'Survey for Langboard, Inc.,' prepared by Carlton Evans, Georgia Registered Land Surveyor, dated October 14, 1996, and recorded in Plat Record Book 5, page 66, public records of the Clerk of the Superior Court of Atkinson County, Georgia, to which map or plat of survey and the record thereof reference is hereby made for all purposes of description.
THERE IS NEVERTHELESS EXCEPTED FROM THE ABOVE AND FOREGOING, the following tracts:
Tract I:
All that certain tract or parcel of land situate, lying and being in Land Lot 19 of the 10th District of Atkinson County, Georgia, which contains fifty (50) acres and is better depicted, described, and delineated on and by that certain plat of survey, dated March 12, 1997, prepared by Statewide Surveying Company for the City of Willacoochee, of record in Plat Record Book 5, page 73, in the Office of the Clerk of the Superior Court of Atkinson County, Georgia; being depicted thereon as '50.00 ACRES.' Said tract is further described as being bounded on the north a distance of 898.64 feet by lands, now or formerly, of Langboard, Inc.; bounded on the east a distance of 2425.76 feet by the west margin of the right of way of Spring-Head Road; bounded on the south a distance of 897.09 feet by lands, now or formerly, of Langboard, Inc.; and bounded on the west a distance of 2425.76 feet, by the east margin of the right of way of the Old Georgia-Florida Railroad.

Tract II:
All that certain tract or parcel of land situate, lying and being in Land Lots 19 and 20 of the 10th Land District of Atkinson County, Georgia, which contains 25.0 acres and is more fully depicted, described and delineated on and by that certain plat of survey, dated 1/5/99, prepared by Claude White, Jr., Surveyor of Atkinson County, Georgia, for the City of Willacoochee, of record in Plat Book 6, page 144, in the office of the Clerk of the Superior Court of Atkinson County, Georgia. Said tract is bounded on the north by lands, now or formerly, owned by the City of Willacoochee; bounded on the east by the west margin of the right of way of Spring-Head Road; bounded on the south by lands, now or formerly, owned by Langboard, Inc., and bounded on the west by lands, now or formerly, owned by the City of Willacoochee, and in part by lands, now or formerly, owned by Langboard, Inc.
The above described property was conveyed to the City of Willacoochee by: (1) quitclaim deed from Development Authority of Atkinson County, dated January 16, 2001, and recorded in Deed Book 167, page 92, public records of Atkinson County, Georgia; (2) by quitclaim deed from Langdale Industries, Inc., dated January 17, 2001, and recorded in Deed Book 167, page 94, aforesaid records; and (3) by quitclaim deed from Langboard, Inc., dated January 12, 1999, and recorded in Deed Book 146, page 302, aforesaid records.

Tract III:

All that certain tract or parcel of land situate, lying and being in original Land Lots 19 and 20 of the 10th Land District of Atkinson County, Georgia, which contains 5.0 acres and is fully depicted, described and delineated on and by that certain plat of survey, prepared by Claude White, Jr., Surveyor for Atkinson County, Georgia, dated 11/13/00, of record in Plat Book 6, page 300, in the office of the Clerk of the Superior Court of Atkinson County, Georgia. Said tract being bounded on the north, now or formerly, by other lands of the City of Willacoochee; bounded on the east by the west margin of the right of way of Spring-Head Road; bounded on the south and west by lands, now or formerly, owned by Langboard, Inc.
The above described property was conveyed to the City of Willacoochee by: (1) quitclaim deed from Development Authority of Atkinson County, dated January 16, 2001, and recorded in Deed Book 167, page 92, public records of Atkinson County, Georgia; (2) quitclaim deed from Langboard, Inc., dated November 30, 2000, and recorded in Deed Book 166, page 154, aforesaid records; and (3) quitclaim deed from Langdale Industries, Inc., dated January 17, 2001, and recorded in Deed Book 167, page 94, aforesaid records.

Tract IV:
All that certain tract or parcel of land situate, lying and being in Land Lot 525 of the 5th Land District of Atkinson County, Georgia, being described as follows: a certain parcel of land 100 feet in length and 100 feet in width bounded on the north, east, south and west by lands, now or formerly, owned by Langboard, Inc. Said property is more particularly described in warranty deed from Langboard, Inc., to The City of Willacoochee, Georgia, dated April 14, 1998, and recorded in Deed Book 140, page 249, public records of Atkinson County, Georgia."

SECTION 2.
All laws and parts of laws in conflict with this Act are repealed.
