A BILL TO BE ENTITLED
AN ACT


To amend an Act establishing the board of elections and registration for Pickens County, approved April 13, 2001 (Ga. L. 2001, p. 3598), so as to change provisions relating to the terms of office and composition of its members; to change provisions relating to meetings of the board; to provide for effective dates; to repeal conflicting laws; and for other purposes.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:

SECTION 1.
An Act establishing the board of elections and registration for Pickens County, approved April 13, 2001 (Ga. L. 2001, p. 3598), is amended by adding a new subsection to Section 2, as follows:
"(e)(1) Notwithstanding any other provisions herein, beginning January 1, 2008, there shall be five positions for the Pickens County Board of Elections. Position One and Position Three shall be appointed by the chairperson of the county executive committee of the political party whose candidate at the last preceding general election held for the election of Governor received the largest number of votes in the state for Governor; Position Two and Position Four shall be appointed by the chairperson of the county executive committee of the political party whose candidate at the last preceding general election held for the election of Governor received the next largest number of votes in this state for Governor, subject to the provisions of Section 2(a) of this Act. Position Five shall be appointed by a majority vote of the other four members of the board, subject to the provisions of Section 2(b)(2) of this Act.
(2) The appointments for Positions One and Two shall be for an initial term of two years, to wit, January 1, 2008, through December 31, 2009; thereafter, said terms for Positions One and Two shall be for a period of four years, for example, January 1, 2010, through December 31, 2013.
(3) The appointments for Positions Three, Four, and Five shall be for a period of four years, for example, January 1, 2008, through December 31, 2011."
SECTION 2.
Said Act is amended further by revising subsection (a) of Section 9, as follows:
"(a) The board shall fix and establish, by appropriate resolution entered on its minutes, directives governing the execution of matters within its jurisdiction. The board shall hold regular monthly meetings at a time and place to be fixed by resolution of the board. All meetings shall comply with the Open Meetings Laws and Open Records Laws of the State of Georgia."

SECTION 3.
Section 1 of this Act shall become effective on January 1, 2008, and Section 2 of this Act shall become effective on July 1, 2007.

SECTION 4.
All laws and parts of laws in conflict with this Act are repealed.
