A BILL TO BE ENTITLED
AN ACT


To amend Part 5 of Article 3 of Chapter 5 of Title 12 of the Official Code of Georgia Annotated, relating to public water systems, so as to require certain contractors that operate public water systems to give performance bonds for water supply; to repeal conflicting laws; and for other purposes.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:

SECTION 1.
Part 5 of Article 3 of Chapter 5 of Title 12 of the Official Code of Georgia Annotated, relating to public water systems, is amended by adding a new Code section to read as follows:
"12-5-179.1.
Any private person who operates a public water system pursuant to contract with a county, municipality, or local government authority shall be required to give a performance bond, payable to the county, municipality, or local government authority and issued by an insurance company authorized to issue such bonds in this state, conditioned upon faithful compliance with the contract and in such amount as determined by the county, municipality, or local government authority as necessary to assure the continued supply of water in accordance with such contract. No such contract for which a performance bond is required shall be valid for any purpose unless the contractor shall give such performance bond. This Code section shall apply to all such contracts entered into or renewed on or after the effective date of this Code section."

SECTION 2.
All laws and parts of laws in conflict with this Act are repealed.
