A BILL TO BE ENTITLED
AN ACT


To amend Code Section 40-5-2 of the Official Code of Georgia Annotated, relating to records to be kept on drivers in Georgia, so as to prohibit the Department of Driver Services from charging a fee for viewing a driver´s record online; to provide for related matters; to provide an effective date; to repeal conflicting laws; and for other purposes.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:

SECTION 1.
Code Section 40-5-2 of the Official Code of Georgia Annotated, relating to records to be kept on drivers in Georgia, is amended by revising subsection (j) as follows:
"(j) The commissioner is authorized to promulgate any rules, regulations, or policies as are necessary to carry out the provisions of this Code section. In accordance with paragraph (6) of subsection (a) of Code Section 50-25-4, reasonable fees shall be assessed for furnishing information from records or data bases pursuant to provisions of this Code section; provided, however, that the fee for furnishing an abstract of a driver´s record shall not exceed $10.00; and provided, further, that there shall be no fee charged for providing an individual his or her personal driving record on line."

SECTION 2.
This Act shall become effective on July 1, 2007.

SECTION 3.
All laws and parts of laws in conflict with this Act are repealed.
