A
BILL TO BE ENTITLED
AN ACT
AN ACT
To
amend Code Section 36-62-5.1 of the Official Code of Georgia Annotated, relating
to joint authorities, so as to provide that if so provided by local law
applicable to an authority which has been created and activated, no resolution
creating and activating a joint authority shall authorize authority members or
directors to nominate or appoint their successors in office; to repeal
conflicting laws; and for other purposes.
BE
IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
SECTION
1.
Code
Section 36-62-5.1 of the Official Code of Georgia Annotated, relating to joint
authorities, is amended by revising subsection (c) as follows:
"(c)
The resolutions creating and activating a joint authority shall specify the
number of members of the authority, the number to be appointed by each
participating county or municipal corporation, their terms of office, and their
residency
requirements;
provided, however, that if so provided by local law applicable to an authority
which has been created and activated, no such resolution shall authorize the
members or directors of the authority to nominate or appoint their successors in
office."
SECTION
2.
All
laws and parts of laws in conflict with this Act are repealed.
