A BILL TO BE ENTITLED
AN ACT


To amend Code Section 12-8-24 of the Official Code of Georgia Annotated, relating to permits for solid waste or special solid waste handling, disposal, or thermal treatment technology facility and inspection of solid waste generators, so as to change certain provisions relating to permit requirement; to provide for authorization by local Act of the General Assembly as a precondition for the granting of a permit for construction of a new landfill; to provide an effective date; to repeal conflicting laws; and for other purposes.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:

SECTION 1.
Code Section 12-8-24 of the Official Code of Georgia Annotated, relating to permits for solid waste or special solid waste handling, disposal, or thermal treatment technology facility and inspection of solid waste generators, is amended by revising subsection (a) as follows:
"(a)(1) No person shall engage in solid waste or special solid waste handling in Georgia or construct or operate a solid waste handling facility in Georgia, except those individuals exempted from this part under Code Section 12-8-30.10, without first obtaining a permit from the director authorizing such activity.
(2) In addition to any other requirements of this article, the direction shall not issue any permit pursuant to application made on or after the effective date of this Code section for construction of a new landfill in any county or municipality unless at the time of such application the construction and operation of new landfills in such jurisdiction is authorized by local Act of the General Assembly. Any such local Act shall be limited solely to a general authorization for such jurisdiction applicable to all new landfill permit applicants, with no other conditions or requirements."

SECTION 2.
This Act shall become effective upon its approval by the Governor or upon its becoming law without such approval.
SECTION 3.
All laws and parts of laws in conflict with this Act are repealed.
