A BILL TO BE ENTITLED
AN ACT


To amend Article 7 of Chapter 4 of Title 49 of the Official Code of Georgia Annotated, relating to medical assistance generally, so as to provide that an applicant for medical assistance born prior to December 31, 1919, shall not be required to have a birth certificate as proof of identification for purposes of eligibility for medical assistance; to provide for applicability; to provide for related matters; to repeal conflicting laws; and for other purposes.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:

SECTION 1.
Article 7 of Chapter 4 of Title 49 of the Official Code of Georgia, relating to medical assistance generally, is amended by adding a new Code section to read as follows:
"49-4-150.1.
(a) Unless otherwise mandated by federal law or regulation, the department shall not require a birth certificate from an applicant for medical assistance who was born prior to December 31, 1919, as proof of identification for purposes of eligibility for medical assistance. Such applicant may show proof of identification through other means, as determined by the department, including, but not limited to, an expired driver´s license or other photographic identification or an affidavit signed by the applicant listing the names of the applicant´s parents and the applicant´s birthdate.
(b) This Code section shall apply to applications submitted by applicants for medical assistance on and after the effective date of this Code section."

SECTION 2.
All laws and parts of laws in conflict with this Act are repealed.
