A BILL TO BE ENTITLED
AN ACT


To amend Article 14A of Chapter 1 of Title 10 of the Official Code of Georgia Annotated, relating to flea market vendors´ record keeping, so as to restrict the sale of certain items at flea markets; to provide for a misdemeanor; to provide for a fine; to repeal conflicting laws; and for other purposes.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:

SECTION 1.
Article 14A of Chapter 1 of Title 10 of the Official Code of Georgia Annotated, relating to flea market vendors´ record keeping, is amended by revising the introductory language to subsection (a) of Code Section 10-1-360, relating to definitions regarding flea markets, as follows:
"(a) As used in this Code section article, the term:"

SECTION 2.
Said article is further amended by adding a new Code section to read as follows:
"10-1-363.
(a) As used in this Code section, the term 'drug' shall have the same meaning as specified in Code Section 26-3-2.
(b) Neither food manufactured and packaged for sale for consumption by a child under the age of two years nor drugs shall be offered for sale or sold at a flea market. Any person violating the provisions of this Code section shall be guilty of a misdemeanor, punishable by a fine not greater than $100.00 per item."

SECTION 3.
All laws and parts of laws in conflict with this Act are repealed.
