A BILL TO BE ENTITLED
AN ACT


To amend Chapter 31 of Title 36 of the Official Code of Georgia Annotated, relating to incorporation of municipalities, so as to provide for additional requirements with respect to local Acts of the General Assembly proposing the creation of new municipal corporations; to provide for an effective date; to repeal conflicting laws; and for other purposes.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:

SECTION 1.
Chapter 31 of Title 36 of the Official Code of Georgia Annotated, relating to incorporation of municipalities, is amended by adding a new Code section as follows:
"36-31-13.
(a) Local Acts of the General Assembly proposing the creation of a new municipal corporation in any county in which 50 percent or more of the total population of the county, as determined by the most recent United States decennial census, resides in the unincorporated area of the county shall be adopted pursuant to the procedures of this Code section.
(b) Such bill shall include a requirement for referendum approval of the creation of the municipal corporation in both proposed corporate limits of the new municipality and the entire county."

SECTION 2.
This Act shall become effective upon its approval by the Governor or upon its becoming law without such approval.

SECTION 3.
All laws and parts of laws in conflict with this Act are repealed.
