BILL TO BE ENTITLED
AN ACT
AN ACT
To
amend Chapter 5 of Title 30 and Code Section 31-8-81 of the Official Code of
Georgia Annotated, relating to protection of disabled adults and elder persons
and definitions for the "Long-term Care Facility Resident Abuse Reporting Act,"
respectively, so as to revise the definition of the term "exploitation"; to
change provisions relating to criminal penalties; to provide for related
matters; to repeal conflicting laws; and for other purposes.
BE
IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
SECTION
1.
Chapter
5 of Title 30 the Official Code of Georgia Annotated, relating to protection of
disabled adults and elder persons, is amended by revising paragraph (9) of Code
Section 30-5-3, relating to definitions, as follows:
"(9)
'Exploitation' means the illegal or improper use of a disabled adult or elder
person or that person´s resources
through undue
influence, coercion, harassment, duress, deception, false representation, false
pretense, or other similar means for
another´s profit or advantage."
SECTION
2.
Said
chapter is further amended by revising paragraph (1) subsection (a) of Code
Section 30-5-8, relating to criminal offenses and penalties, as
follows:
"(a)(1)
In addition to any other provision of law,
it shall be
unlawful for any person to
the
abuse, neglect, or
exploit
exploitation
of any disabled adult or elder person
shall be
unlawful."
SECTION
3.
Code
Section 31-8-81 of the Official Code of Georgia Annotated, relating to
definitions for the "Long-term Care Facility Resident Abuse Reporting Act," is
amended by revising paragraph (2) as follows:
"(2)
'Exploitation' means an unjust or improper use of another person or
his
the
person´s property
through undue
influence, coercion, harassment, duress, deception, false representation, false
pretense, or other similar means for
one´s own profit or advantage."
SECTION
4.
All
laws and parts of laws in conflict with this Act are repealed.
