A BILL TO BE ENTITLED
AN ACT


To amend Code Section 50-32-14 of the Official Code of Georgia Annotated, relating to expenditures of state and federal funds and developments of regional impact, so as to provide for counties and municipalities outside of the area in which the development of regional impact is planned to reverse the decision of the Georgia Regional Transportation Authority; to provide for related matters; to provide an effective date; to repeal conflicting laws; and for other purposes.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:

SECTION 1.
Code Section 50-32-14 of the Official Code of Georgia Annotated, relating to expenditures of state and federal funds and developments of regional impact, is revised to read as follows:
"50-32-14.
In any case where a development of regional impact, as determined by the Department of Community Affairs pursuant to Article 1 of Chapter 8 of this title, is planned within the geographic area over which the authority has jurisdiction which requires the expenditure of state or federal funds by the state or any political subdivision, agency, authority, or instrumentality thereof to create land transportation services or access to such development, any expenditure of such funds shall be prohibited unless and until the plan for such development and such expenditures is reviewed and approved by the authority. The decision of the authority to allow or disallow the expenditure of such funds shall be final and nonreviewable, except that such decision shall be reversed where a resolution for such purpose is passed by vote of three-fourths of the authorized membership of the county commission of the county in which the development of regional impact is planned or, if such development is within a municipality, by vote of three-fourths of the authorized membership of the city council. If such decision of the authority to allow or disallow the expenditure of such funds pertains to land transportation services or access within a municipality or county other than the county or municipality in which the development of regional impact is planned, such decision shall be reversed where a resolution for such purpose is passed by vote of three-fourths of the authorized membership of the county commission or city council other than the county or municipality where the development of regional impact is planned. Any such county or municipality shall not be required to take such action until such time as the authority votes to deny such funding. Such a vote shall not constitute failure or refusal by the local government for purposes of Code Section 50-32-53."

SECTION 2.
This Act shall become effective upon its approval by the Governor or upon its becoming law without such approval.

SECTION 3.
All laws and parts of laws in conflict with this Act are repealed.
