A BILL TO BE ENTITLED
AN ACT


To create the DeKalb County Justice Technology Fund; to specify the uses to which moneys deposited into the fund may be put; to provide for the auditing and accounting for such fund; to provide for a supervising board for such fund and the authority, powers, and duties thereof; to provide for related matters; to provide an effective date and automatic repeal; to repeal conflicting laws; and for other purposes.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:

SECTION 1.
As used in this Act, the term:
(1) 'Executive committee' means the Executive Committee of the DeKalb County Criminal Justice Coordinating Council.
(2) 'Fund' means the DeKalb County Justice Technology Fund.

SECTION 2.
The DeKalb County Justice Technology Fund is hereby established.

SECTION 3.
The fund shall be under the control and supervision of the Executive Committee of the DeKalb County Criminal Justice Coordinating Council. The executive committee shall have the sole authority to direct the expenditure of funds for technology for the justice system in DeKalb County and may authorize reasonable expenditures for authorized projects from the fund, as necessary. The fund shall be maintained by the county treasurer, who shall:
(1) Maintain accurate records of all funds collected or expended in accordance with this Act;
(2) Reconcile the account using acceptable accounting methods and procedures;
(3) Be subject to the same audit requirements as all other like funds in the county; and
(4) Provide the executive committee with quarterly reports of all expenditures and collections of the fund.

SECTION 4.
Moneys deposited into the fund shall be used to support and fund the planning and implementation of criminal justice information projects approved by the executive committee but shall not be used to supplant those funds appropriated by the DeKalb County Board of Commissioners for technology projects in the criminal justice system. Any unexpended funds shall remain in the fund until needed for criminal justice information initiatives as determined by the executive committee.

SECTION 5.
This Act shall become effective on August 1, 2008, and shall be repealed by operation of law on June 30, 2013.

SECTION 6.
All laws and parts of laws in conflict with this Act are repealed.
