A BILL TO BE ENTITLED
AN ACT


To amend an Act creating and establishing the Recorder´s Court of DeKalb County, approved March 17, 1951 (Ga. L. 1959, p. 3093), as amended, particularly by an Act approved April 25, 2002 (Ga. L. 2002, p. 4612), so as to impose an additional fine for certain offenses; to provide that such fine shall be paid into the DeKalb County Justice Technology Fund; to provide an effective date and automatic repeal; to repeal conflicting laws; and for other purposes.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:

SECTION 1.
An Act creating and establishing the Recorder´s Court of DeKalb County, approved March 17, 1951 (Ga. L. 1959, p. 3093), as amended, particularly by an Act approved April 25, 2002 (Ga. L. 2002, p. 4612), is amended by revising subsection (a) of Section 14 as follows:
"(a)(1) Upon conviction of a violation of any of the ordinances, rules, or regulations set forth by the governing authority of DeKalb County, the Recorder or Judge of said Court may, as prescribed by the ordinance, rule, or regulation, punish an offender by fine, imprisonment in the county jail, labor on the public work gang, or a combination thereof; provided, however, that for any single violation, the amount of the fine shall not exceed the sum of $1,000.00 and the period of any imprisonment or labor shall not exceed 120 days; and provided, further, that the Judge may probate any part or all of any punishment imposed pursuant to this subsection.
(2) There is imposed upon each defendant who is found guilty or enters a plea of guilty or nolo contendere or any other plea that results in a fine an additional fine of $5.00 which the clerk shall pay into the DeKalb County Justice Technology Fund. The clerk shall pay such funds on a monthly basis at the end of each calendar month."

SECTION 2.
This Act shall become effective on August 1, 2008, and shall be repealed by operation of law on June 30, 2013.

SECTION 3.
All laws and parts of laws in conflict with this Act are repealed.
