A BILL TO BE ENTITLED
AN ACT


To amend Part 1 of Article 1 of Chapter 8 of Title 40 of the Official Code of Georgia Annotated, relating to equipment of motor vehicles, so as to prohibit knowingly installing defective airbags or knowingly disabling airbags previously installed in a motor vehicle; to provide for penalties; to provide for related matters; to provide for an effective date; to repeal conflicting laws; and for other purposes.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:

SECTION 1.
Part 1 of Article 1 of Chapter 8 of Title 40 of the Official Code of Georgia Annotated, relating to equipment of motor vehicles, is amended by adding a new Code section to read as follows:
"40-8-11.
(a) It shall be unlawful for any person to knowingly:
(1) Install a defective airbag device; or
(2) Disable a previously installed airbag device
in any motor vehicle in this state.
(b) Any person violating this Code section shall be guilty of a felony and punished by a fine of up to $5,000.00 and imprisonment for up to two years, or both."

SECTION 2.
This Act shall become effective upon its approval by the Governor or upon its becoming law without such approval.

SECTION 3.
All laws and parts of laws in conflict with this Act are repealed.
