BILL TO BE ENTITLED
AN ACT
AN ACT
To
amend Article 2 of Chapter 4 of Title 18 of the Official Code of Georgia
Annotated, relating to property and persons subject to garnishment, so as to
change certain provisions relating to service of summons of garnishment upon
corporations; to provide for related matters; to repeal conflicting laws; and
for other purposes.
BE
IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
SECTION
1.
Article
2 of Chapter 4 of Title 18 of the Official Code of Georgia Annotated, relating
to property and persons subject to garnishment, is amended by revising Code
Section 18-4-23, relating to service of summons of garnishment upon
corporations, as follows:
"18-4-23.
(a)
Service of a summons of
continuing
garnishment shall be made by serving the agent in charge of the office or other
place of business where the defendant is employed. In the event that such
service cannot be made, then service of a summons of
continuing
garnishment upon the agent in charge of
either the registered office or the principal place of business of a corporation
shall be
sufficient
made.
(b)
Service of a summons of garnishment that is noncontinuing shall be made by
serving a summons of garnishment upon the agent in charge of either the
registered office or the principal place of business of a
corporation.
(c)
The methods of service provided for in this Code section shall be the only means
available for service of a summons of continuing garnishment or service of a
summons of garnishment that is noncontinuing upon a corporation incorporated or
domesticated under the laws of this state or a foreign corporation authorized to
transact business in this
state."
SECTION
2.
All
laws and parts of laws in conflict with this Act are repealed.
