BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:

SECTION 1.
Chapter 2 of Title 40 of the Official Code of Georgia Annotated, relating to registration and licensing of motor vehicles, is revised by adding a new Code section to read as follows:

Any such reciprocal agreement or plan shall provide that if this state agrees to issue a special license plate recognizing an institution of higher education or its affiliated athletic program or logo located outside the borders of this state, the state in which the institution of higher education or its affiliated athletic program is located shall agree to issue a special license plate, under the same terms and conditions as the special license plate was issued in this state, recognizing an institution of higher education or its affiliated athletic program or logo located in this state to be designated by the department.
(b) Until a reciprocal agreement, as described in subsection (a) of this Code section, has been executed with the appropriate agency of the other state, the department shall not issue or renew special license plates recognizing an institution of higher learning or its affiliated athletic program or logo located outside the borders of this state.
(c) In the event of conflict between the provisions of this Code section or any agreement entered into under the provisions of this Code section and any other law or provision on this subject, the provisions of this Code section or any agreement entered into under the provisions of this Code section shall prevail.

SECTION 2.
This Act shall become effective on January 1, 2009.

SECTION 3.
All laws and parts of laws in conflict with this Act are repealed.
