BILL TO BE ENTITLED
AN ACT
AN ACT
To
amend Chapter 2 of Title 40 of the Official Code of Georgia Annotated, relating
to registration and licensing of motor vehicles, so as to provide for
reciprocity agreements between states desiring to issue special license plates
recognizing institutions of higher education or affiliated athletic programs or
logos located outside the borders of the issuing state; to provide for related
matters; to provide for an effective date; to repeal conflicting laws; and for
other purposes.
BE
IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
SECTION
1.
Chapter
2 of Title 40 of the Official Code of Georgia Annotated, relating to
registration and licensing of motor vehicles, is revised by adding a new Code
section to read as follows:
"40-2-60.2.
(a)
Notwithstanding any other provision of Article 3 of this chapter, the
commissioner is authorized to enter into reciprocal agreements or plans on
behalf of the State of Georgia with the appropriate authorities of any of the
states of the United States, or the District of Columbia, in order to provide
for reciprocity agreements between states desiring to issue special license
plates recognizing institutions of higher education or affiliated athletic
programs or logos located outside the borders of this state. Any such
reciprocal agreement or plan shall provide that if this state agrees to issue a
special license plate recognizing an institution of higher education or its
affiliated athletic program or logo located outside the borders of this state,
the state in which the institution of higher education or its affiliated
athletic program is located shall agree to issue a special license plate, under
the same terms and conditions as the special license plate was issued in this
state, recognizing an institution of higher education or its affiliated athletic
program or logo located in this state to be designated by the
department.
(b)
Until a reciprocal agreement, as described in subsection (a) of this Code
section, has been executed with the appropriate agency of the other state, the
department shall not issue or renew special license plates recognizing an
institution of higher learning or its affiliated athletic program or logo
located outside the borders of this state.
(c)
In the event of conflict between the provisions of this Code section or any
agreement entered into under the provisions of this Code section and any other
law or provision on this subject, the provisions of this Code section or any
agreement entered into under the provisions of this Code section shall
prevail.
(d)
The department is authorized and empowered to promulgate and to enforce such
rules and regulations as may be necessary to carry out the provisions of this
Code section or any agreement entered into under the authority set forth in this
Code section."
SECTION
2.
This
Act shall become effective on January 1, 2009.
SECTION
3.
All
laws and parts of laws in conflict with this Act are repealed.
