A RESOLUTION

Creating the Senate Environmental Program Privatization Study Committee; and for other purposes.

WHEREAS, the introduction of public-private competition into the delivery of environmental protection programs, services, and activities may result in improvements in the effectiveness, efficiency, and costs of such programs, services, and activities; and

WHEREAS, it may be advantageous to identify disincentives toward efficiency and cost effectiveness in government enforcement and implementation of environmental laws and regulations and how the introduction of private sector competition or incentives may result in higher quality performance and more effective implementation of such policies and programs; and

WHEREAS, there is a perceived need to focus on areas where new legislation may give the Environmental Protection Division and the Department of Natural Resources more flexibility to choose or "shop" and negotiate among private sector providers for the highest quality and lowest cost performance, specifically with respect to:

(1) The involvement of the private sector in department or division management and delivery of environmental protection programs, services, and activities;
(2) The transfer of department or division functions or assets or shifting of government management and service delivery to the private sector;
(3) The enhancement of department or division access to special skills or technical expertise which are not available in-house;
(4) The authorization of department or division access to private sector providers in instances where it would not be cost effective to hire directly in-house; and
(5) The involvement of private sector providers in circumstances where they would provide more rapid or timely start up for new or reorganized programs, services, or activities.


NOW, THEREFORE, BE IT RESOLVED BY THE SENATE that there is created the Senate Environmental Program Privatization Study Committee to be composed of five members of the Senate to be appointed by the Senate Committee on Assignments. The Senate Committee on Assignments shall designate a member of the committee as chairperson of the committee. The chairperson shall call all meetings of the committee.

BE IT FURTHER RESOLVED that the committee shall undertake a study of the conditions, needs, issues, and problems mentioned above or related thereto and recommend any action or legislation which the committee deems necessary or appropriate. The committee may conduct such meetings at such places and at such times as it may deem necessary or convenient to enable it to exercise fully and effectively its powers, perform its duties, and accomplish the objectives and purposes of this resolution. The members of the committee shall receive the allowances provided for in Code Section 28-1-8 of the Official Code of Georgia Annotated. The allowances authorized by this resolution shall not be received by any member of the committee for more than five days unless additional days are authorized. The funds necessary to carry out the provisions of this resolution shall come from the funds appropriated to the Senate. In the event the committee makes a report of its findings and recommendations, with suggestions for proposed legislation, if any, such report shall be made on or before December 1, 2005. The committee shall stand abolished on December 1, 2005.
